Terms of Business
Our terms of business for both temporary and permanent staff provided by Kathy Chadd Recruitment Ltdare set out below:
Temporary Staff (see below for Permanent Employees)
1. These terms and conditions of business are between Kathy Chadd Recruitment Ltd (KCR) and the Client.
2. The engagement of a Temporary Worker (Temp) introduced by KCR will be deemed as acceptance by the Client of the terms and conditions specified.
3. The Client agrees to pay the hourly charges of KCR (as advised at the time of booking) for the actual hours as worked by the Temp.
4. Payment is against our weekly invoices and settlement is required within 7 days of presentation (i.e. payable by return) as invoices are in respect of wages already paid. A late payment fee equivalent to 2% per months will be added on a daily, pro-rata, basis.
5. KCR assumes responsibility for payment of wages (including paid annual leave), deduction and payment of all statutory contributions in respect of earnings, related insurance and the administration of schedule E income tax (PAYE) applicable to the Temp, as required by law.
6. Should a member or former member of our Temp Staff be directly engaged by the Client (either during or at any time within 3 months after termination of a temporary engagement with such Client) the Client must notify KCR of the commencement date and pay the appropriate engagement fee (item 6 of our Terms of Business - Permanent Staff) or settlement as may be negotiated.
7. The Client undertakes to supervise the Temp assigned sufficiently to ensure the Client’s satisfaction with reasonable standards of workmanship, but if the standards of a Temp prove to be unsatisfactory, KCR may reduce or cancel the charge for the time worked by that Temp provided that the Temp leaves that assignment immediately and that notification, which must be confirmed in writing, is received either:-
7.1. Within 4 hours of the Temp commencing duties where the booking is for more than 7 hours and 7.2. Within 2 hours for a booking of 7 hours or less
We will, subject to availability, replace immediately and make no charge for the first 4 hours of service.
There is a minimum charge per Temp of 4 hours for any one assignment. Time and one half is charged for all time worked by our temps in excess 40 hours per week.
8. Whilst every effort is made by KCR to maintain high standards of integrity and reliability among our Temps, KCR assumes no liability for any loss, expense, damage or delay arising from any failure, dishonesty, misconduct, or lack of skill of the Temps provided. The Client will in all respects comply with all statutes, bye-laws and legal requirements to which the Client is ordinarily subject in respect of the Client’s own staff, but excluding the matters specifically mentioned in item 5 above.
9. In line with the Work Time Regulations introduced on 1st October 1998:
Any Temp is entitled to 4.8 weeks annual leave on a pro rata basis, this cost is already included in the hourly rate.
Temps may not work for more than 48 hours on average over a 17 week period unless previously agreed in writing with KCR and the individual.
Temps are entitled to a minimum of a 20 minute rest break during their working day (if this is more than 6 hours), one day off each week and 11 hours consecutive rest each day.
10. No alteration or variation can be made to these terms without the written consent of the Directors of KCR.
Permanent Employees (see above for Temporary Staff)
1. These terms and conditions of business are between Kathy Chadd Recruitment Ltd (KCR) and the Client.
2. Part of our recruitment process may include advertising in the media. However, company names are withheld. The cost of advertising will be at your own expense and will be the actual cost charge by the media to ourselves (gold and silver packages only).
3. The interviewing of an applicant introduced by KCR will be deemed as acceptance by the Client of the Terms and Conditions specified.
4. The Client agrees to notify KCR immediately a placement is accepted and to pay the fee within 28 days of the commencement of the engagement. A late payment fee of 2% per month will be added, pro-rata, daily.
5. All introductions are confidential and the passing on of an introduction to any other parties which may result in a permanent or temporary placement renders the Client liable to payment of our fees set out in item 6.
6. The introduction fee for the permanent placement through KCR is a percentage of the commencing gross salary plus VAT. This is between 5% and 12% depending on the level of service your require from us and is discussed and agreed with you in advance. Full details of our gold. silver and bronze packages are readily available.
7. Should the relevant employment terminate within a 3 calendar month period, the scale of rebate below will apply providing the Client notifies us in writing within 7 days of the termination and within the proviso that:-
7.1. The invoice has been settled within 28 days of the commencement date. 7.2. That the recruit has not left due to the Client being in breach of the Employment Act(s) as in force at the current time. 7.3. That should the Client, or any subsidiary or associated company of the Client, subsequently re-engage the applicant within the period of 6 months from the date of termination, a full fee in accordance with item 6 becomes payable.

Rebate applies only to our silver and gold packages and not to our bronze package.
8. After the recruit has been in the Client’s employment for longer than the guarantee period, as detailed in item 7, no requests for credit or rebate will be allowed.
9. Should a member or former member of our temporary staff be directly engaged by the Client (either during or any time within 3 months after termination of a temporary engagement with such Client), the Client must notify KCR of the date of commencement and pay the appropriate permanent engagement fee or settlement as may be negotiated. In such cases no rebates will, in any circumstances, be allowed since it is considered that during the temporary employment the Client and the Employee have had the opportunity of confirming their mutual suitability.
10. Whilst every effort is made by KCR to maintain high standards of integrity and reliability among our recruits, KCR assumes no liability for any loss, expense, damage or delay arising from any failure, dishonesty, misconduct or lack of skill of the placements provided.
11. Not withstanding all of the above, the Client shall satisfy itself as to the suitability of any placement and shall be responsible for obtaining references, work and other permits, examination and/or investigations into the medical history and other requirements or qualifications as may be required by the Client or the Law.
12. No alteration or variation can made to these terms without the written consent of the Directors of KCR.
